How to Get to 'Yes': Solving the Puzzle of Intercreditor Agreements

Intercreditor agreements continue to be a challenge in getting a deal done, particularly in view of the evolving case law surrounding their interpretation. ACFA members Jim Schulwolf and David Morse will lead a panel that will review the case law addressing the key terms in intercreditor agreements. The panel will also engage in a discussion of the issues which typically arise between creditors with conflicting positions, including the perspective of the first lien lender and the second lien lender. Hear the arguments on both sides and potential solutions. Determine where you can agree and where you may have to “just say no”!
