Our presentation will cover aspects of leasing law and practice that could either facilitate or impede a lessor’s or its assignee’s collecting the rent and other payments from their lessee customers. Among other things, we will discuss the reliability of “hell or high water” provisions, default triggers, liquidated damages provisions and other remedies, allocation of equipment, tax and third party liability risks, and assignability rights, including waiver of defense clauses. We will also cover whether certain equipment financing transactions documented as leases may not be "true leases” under the UCC and applicable commercial law, and why that might have implications as to whether and how much the lessor or its assignee gets paid.
The cost of this event is included in the annual membership dues of ACFA members. The cost for non-members is $90, which may be credited toward the cost of dues if the non-member decides to join ACFA within one year.
